US Department of Commerce expands export restrictions on Russia

The US Department of Commerce has expanded export restrictions on Russia and Belarus, 70 Russian organizations and one Belarusian organization fell under them.

US Department of Commerce explains the restrictions by saying that the organizations are involved “in activities contrary to the national security or foreign policy interests of the United States,” in particular “in the acquisition or attempted acquisition” of American goods to support the armed forces of their countries.

Among the Russian organizations included in the list of the Ministry of Trade:

  • Ak Bars Holding Company,
  • Rubin Joint-Stock Company,
  • LLC ;Gazprom Neft Shelf»,
  • Aviation Complex named after S.V. Ilyushin,
  • Eleron Special Research and Production Association,
  • OKB im. Yakovleva,
  • Voentelekom,
  • Institute for Marine Technology Problems, Far Eastern Branch of the Russian Academy of Sciences, etc.

In addition, the list includes one Belarusian legal entity— Belarusian representative office of Eleron.

Organizations are listed, implying strict control over exports to their address. Licenses for the export, re-export and transfer within Russia of goods subject to US export regulation (in the broad sense — dual-use goods) to these enterprises will be considered with a presumption of refusal, that is, in fact, we are talking about an embargo on the supply of dual-use goods to these organizations.

At the same time, most of the Russian legal entities that have fallen under the restrictions are classified as “end users in the military sphere”, so they will additionally be subject to the foreign direct product (FDP) rule. We are talking about limiting the supply to Russian organizations not only of high-tech goods of direct American production, but also of goods from other countries that use American technology, by analogy with the measures against the Chinese telecommunications corporation Huawei.

In early April, the US authorities banned exports products to 120 Russian and Belarusian organizations connected, in particular, with the defense sector. Then the special unit of the KGB of Belarus “Alpha” fell under the restrictions.
